Immigration, Refugees and Citizenship Canada (IRCC) has ended a temporary policy that permitted visitors to apply for Canadian work permits from within the country. The decision marks a significant departure from the more flexible approach adopted during the COVID-19 pandemic and aligns with the Government of Canada’s broader efforts to manage the influx of temporary residents.

A Look Back at the Temporary Policy

Introduced in August 2020, the policy was designed to assist visitors who could not return to their home countries due to pandemic-related travel restrictions. Under the policy, visitors could submit applications for Canadian work permits without leaving Canada. Additionally, foreign nationals who had previously held Canadian work permits but transitioned to visitor status were eligible to work legally while awaiting a decision on their new permit applications.

The Policy Termination

This policy termination signifies a broader reworking of Canada's immigration policies. Recent Government of Canada actions, including limitations on the Temporary Foreign Worker Program (TFWP) and shortened employment terms for low-wage workers, indicate a focus on managing and potentially reducing the number of temporary residents in Canada. Immigration Minister Marc Miller has also hinted at potential adjustments to permanent residency levels shortly.

While the temporary policy was initially set to expire in February 2025, IRCC says the need to review temporary resident populations and safeguard the integrity of the immigration system for its early termination.

Implementing Stricter Measures Against Immigration Fraud

IRCC has cited the exploitation of the policy by 'bad actors' as a contributing factor to its early termination. This aligns with the department's broader efforts to combat immigration fraud and reduce the number of temporary residents in Canada.

What Happens to Canadian Work Permits Already Submitted?

IRCC will continue to process Canadian work permit applications submitted under the temporary policy before August 28, 2024. The department emphasizes its commitment to efficient and transparent processing of all work permit applications and urges applicants to ensure complete and accurate submissions.

Future Directions for Canadian Immigration Policy

Terminating the temporary policy raises questions about IRCC's plans for Canadian immigration policy. While the department has stated its intention to revise the number of temporary residents, it remains unclear how this will be achieved. IRCC may introduce new policies or programs to address the needs of foreign workers and students in Canada.

As the situation continues to evolve, it is essential for individuals who are affected by the policy change to stay informed about the latest updates and guidance from IRCC.
